On February 6 2002 R. M. Aliyev made a statement where he asked the court to leave the statement of claim in part of demand to publish a refutation of not corresponding to reality data without examination (point 2 of the statement of claim). The court satisfied the request of the plaintiff. On the same day the court rendered a definition in regard to conduction of examination. The court defined to assign psychological-philological examination, execution of which shall be entrusted to Center of judicial examinations of the Ministry of justice of the Republic of Kazakhstan. The following issues are set for resolution of experts: A) Does the aforementioned material contain evaluation of personality and activity of the plaintiff? B) Does the publication contain statements giving negative evaluation to personality of the plaintiff? C) What is the notional context of the given fragment? D) What are the chances of psychological impact on mass conscience of user (reader) of the web-site of “Internews Network Kazakhstan”? For the time being production on the case is interrupted. |
