The first trial session of Almaty municipal court took place on January 17 2002. During the session the defendant presented a petition on leaving the suit of R. M. Aliyev without consideration due to the fact that according to requirements of the law “On mass media” R. M. Aliyev first of all had to appeal with request to publish a refutation, and than appeal to court. The court did not satisfy the given petition. The defendant presented one more petition. In accordance with the Civil Code of the Republic of Kazakhstan, the representative office of “Internews network” in Kazakhstan is not a legal entity and according to the statute on the Representative office of Internews Network in Kazakhstan does not bear independent responsibility, but the proper defendant - Internews Network USA shall bear the responsibility. This petition was declined. However the court satisfied the petition of R. M. Aliyev on demanding additional proofs from the representative office of Internews Network in Kazakhstan. During this trial session R. M. Aliyev declared that he excludes points 3 and 4 from the statement of claim.
