Article 9. Openness of the Court Proceeding
Case hearings in all courts shall be open, except for
cases when it contradicts the interests of state secrecy protection. Besides, a close court session shall be permissible in
response to a decision based on good cause by a court in order to
prevent divulging an information on the intimate aspects of life of
persons participating in the matter, as well as to guarantee the secrecy
of adoption. During the case hearing in close court session, there
shall be persons participating in the matter or their representatives,
representatives of public organizations, and in some cases, witnesses,
experts and interpreters, if necessary. Citizens of less than 16 years of age, if they are not
the participants of the matter or witnesses, shall not be admitted to
the hall of the court session. Case hearings in close court sessions shall be conducted
with the observation of all procedural rules of the court proceeding.
Decisions of courts in all cases shall be declared publicly. |
